You own 100% of your reference assets and generated marketing outputs. ScalyFied acts as your dedicated technological and creative service partner. We operate under strict mutual confidentiality and verified Meta platform standards.
1. Agreement to Terms
By accessing our marketing site, purchasing an enterprise service retainer, or connecting your social media accounts via Meta Graph API to ScalyFied ("the Service"), you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you ("Client") and ScalyFied Technology Pvt Ltd ("Company").
2. Description of Services
ScalyFied delivers enterprise-grade AI social media operations, including:
- Photographic portrait preservation with zero facial distortion.
- Regional dialect copywriting across Gujarati, Hindi, and Indian English.
- OpusClip-accelerated 9:16 vertical video reel production.
- Server-to-server scheduled publishing directly to connected Instagram & Facebook pages via Meta Graph API v20+.
- Dedicated agency multi-workspace management and growth analytics.
3. Intellectual Property & Content Ownership
Client Content: You retain exclusive, complete ownership of all reference photographs, logos, brand emblems, and text provided to us.
Generated Outputs: Upon full payment of the applicable service retainer, you own all rights, title, and interest in all synthesized images, copywriting, and video reels produced for your account. ScalyFied does not claim copyright ownership over your approved campaign outputs.
4. Ethical AI & Acceptable Use Standards
ScalyFied is engineered exclusively for genuine brand building, civic constituent communication, and legitimate commercial marketing. You agree never to use the Service for:
- Creating non-consensual deepfakes, deceptive impersonations of third parties, or defamatory media.
- Generating hate speech, electoral misinformation, or content that violates applicable laws of India or international jurisdictions.
- Publishing materials that infringe on third-party intellectual property or privacy rights.
5. Meta Platform Integrations
Our direct publishing feature relies on Meta's official Graph API. Clients must maintain active, good-standing Instagram Professional Accounts and Facebook Pages. ScalyFied is not liable for service interruptions caused by Meta platform downtime, API deprecations, or account strikes resulting from external content violations.
6. Retainers, Billing & Cancellations
Service retainers are billed on a recurring monthly or annual basis as selected during onboarding. You may cancel your retainer at any time through your account portal or by contacting your account director. Cancellations take effect at the conclusion of the current prepaid billing period.
7. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India. Any legal dispute, arbitration, or proceedings arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in Ahmedabad, Gujarat, India.
